Get everything in writing. Eagerly, an agent may smile, nod his head and answer "yes" to your questions. "Is the garden bench staying?" "Do the almost-new washer/dryer come with the house?" Agents make mistakes. Sellers change their minds. Take notes as you walk through the home. Make a list of everything you'd like to have included in the deal. A seller may be willing to part with a favorite piece of furniture in order to make a closing sale. Remember to make sure that all items in question are specifically written into the contract. The written contract overrides all verbal agreements. Sometimes the written contract gives the buyer items the seller did not intend to leave behind. For example, the contract states"all appliances stay with the house." The seller intended to leave the dishwasher, stove, refridgerator, washing machine and dryer, however the seller wanted to keep the deep freezer in the basement. She did not think about it when she wrote "all appliances" in the contract. The buyer gets to keep the freezer because it's in the contract.
